Debt recovery

Recovery of debts can be difficult especially where the debtor cannot be traced or has taken advantage of legal loopholes to avoid paying their debts. We leverage on our experience and strong networks outside to ensure that our clients can successfully trace and recover assets from the debtors, in country and beyond.

Our litigation team is comprised of seasoned lawyers who use their courtroom and alternative dispute resolution skills to successfully claim on behalf of our clients in multiple jurisdiction.

Employment and labour disputes

Employment relationships don’t often go as one hopes and there inevitably arise disputes between the employer and employees. Our experience working for both employers as well as employees allows us to anticipate and navigate potential pitfalls and advice our clients on the best way to resolve them. We understand that litigation may not always resolve the disputes and are agile enough to explore other forms of dispute resolution available ensuring that our clients can resolve their differences with their best interests in mind.

Environment and land disputes

Our understanding of the mechanics of real estate development through representation of the largest developers in East Africa, enables us to offer a full service from transaction advisory to dispute resolution before courts of law and special tribunals.

Landlord-Tenant disputes

We have represented landlords and tenants in drafting agreements to govern their relationships. Our litigation and real estate teams work seamlessly to ensure that our clients have a smooth transition into and out of a landlord-tenant relationship.

Tax compliance disputes

Tax compliance can be a challenge where clients fail to comprehend their tax obligations or fail to comply with tax laws. Our knowledge on Kenyan tax law enables us to advice clients on their obligations as well as challenge any adverse tax decisions.

Some of the Dispute Resolution matters that we have handled
  • Acting on a cross-border case involving the United Kingdom, Switzerland, the United States and Seychelles. We have assisted Safaricom in tracing the fraudsters and their assets and secured judgement against them in the Kenyan courts.
  • Acting for an international company in arbitration proceedings, in relation to the cancellation of a bitumen supply contract.
  • Successfully represented a company linked to the infamous National Youth Service financial scandal. The company had its accounts frozen. We managed to prove our client’s innocence and had its accounts (with an estimated value of USD 300,000) unfrozen.
  • Acting for a number of large companies before the Kenya Revenue Authority Tax Tribunal.
  • Successfully represented an international construction company in sanctions proceedings before the Africa Development Bank Tribunal.
